Reasons a certifier registration application may be refused
An application may be refused for several reasons under the Building and Development Certifiers Act 2018 and the Mutual Recognition (New South Wales) Act 1992.
Reasons for refusal under the Building and Development Certifiers Act 2018
Reasons an application may be refused under the Building and Development Certifiers Act 2018 include (but are not limited to) a person who:
- is disqualified from being registered
- is under 18 years old
- does not meet the requirements for qualifications, experience, knowledge and skills
- is not a fit and proper person to carry out certification work
- is mentally incapacitated
- has been convicted of a relevant offence within the last 10 years
- has engaged in corrupt conduct
- is an undischarged bankrupt
- has contravened a requirement of this Act or another Act
- has an equivalent authorisation cancelled or suspended, unless requested by them
- is disqualified from being registered in another Australian jurisdiction
- has a close associate that exercises a significant influence over them, or the operation or management of their business and that person is not a fit and proper person
- has not provided details or information requested by Building Commission NSW.
Reasons for refusal under the Mutual Recognition Act 1992
Reasons your application under the Mutual Recognition Act 1992 may be refused include (but are not limited to):
- any statements or information provided are materially false or misleading.
- required documents or information are not provided or are materially false or misleading.
- the occupation in your home state is deemed not equivalent to the registration being sought in NSW, and equivalence cannot be achieved with conditions.
