Liquor & Gaming NSW Compliance Campaign - location of cash dispensing facilities
Since 1 January 2025, cash dispensing facilities at hotels and registered clubs have been subject to new distance and line of sight requirements under the Gaming Machines Regulation 2019.
Liquor & Gaming NSW (L&GNSW) has undertaken extensive industry engagement in the lead up to these changes coming into effect to help venue operators understand their obligations, including:
- An educational campaign in December 2024 that saw over 700 on-site engagements at hotels and registered clubs
- An online webinar hosted by L&GNSW
- Presentations at several local liquor accords, and
- Fielding enquiries via L&GNSW’s Hospitality Concierge.
The December compliance activity identified around 70% of venues had already proactively moved their cash dispensing facility or had the move scheduled for prior to 1 January 2025.
What have we seen since the new requirements came into effect?
L&GNSW has conducted over 200 compliance inspections to test compliance with the new requirements, identifying a compliance rate of 87%.
Some venues attempted compliance but did not meet the new requirements. L&GNSW has worked with these venues to achieve compliance. Some common observations include:
- The ATM has been moved but is still within 5 metres of a gaming entrance due to failure to appropriately consider where the gaming entrance begins (consideration should be given to the physical built environment, approved floor plan and mandatory compliance signage).
- Venues applying a 5 metre walking distance measurement, instead of a 5 metre radius.
- New partitions have been installed but are not preventing line-of-sight to a gaming entry, area or machine. For example, the partition is not wide enough, not tall enough, or there is visibility through the partitions due to gaps or holes from the design pattern.
- ATM providers have been engaged but venues have not scheduled a service for the relocation.
What if my venue is not yet compliant?

From 1 February 2025, L&GNSW will take a zero-tolerance approach to enforcing these requirements. Venues operating cash dispensing facilities that are unable to comply with distance and line of sight requirements after this date, for any reason, will need to take action, and for some venues this may mean disabling the machine until such time as compliance can be achieved.
