Registered Clubs Regulation 2025
The Registered Clubs Regulation 2015 which was due to be repealed on 1 September 2025 has been renewed.
What does the Regulation do?
It sets out the administrative requirements for registered clubs to ensure operations are transparent, reasonable and meet community expectations.
What are the changes?
The Registered Clubs Regulation 2025 primarily rolls over existing provisions, with some amendments to improve the operation and clarity of the Regulation. These changes were consulted on and include:
- the memorandum of understanding between amalgamating clubs specifying how employee leave and entitlements will be protected [Section 9(2)(d)]
- updated references to training units for board members [Section 21]
- the information to be shared with L&GNSW about proposed management contracts now being specified in the Regulation (as opposed to just in the guidelines) [Schedule 1, Section 6]
- capping member requests for financial statements to 5 years, where no timeframe was previously specified [Schedule 1, Section 11(1)]
- financial reporting to the board at the individual club level, where practicable, to remove uncertainty for amalgamated clubs [Schedule 1, Section 11]
- governing body appointed directors are not required to comply with eligibility requirements in the club’s constitution [Section 26(2)(b)]
- reports on gaming machine profits to members can either be on the financial year or gaming machine tax year [Schedule 1, Section 10(2)(l) and 10(3)]
- the disclosure of top executive salaries in aggregate in line with the Corporations Act requirements (contract details to be disclosed were previously unspecified, creating uncertainty) [Schedule 1, Section 10(2)(d) and (e)]
- permitting volunteer secretaries but requiring a formal agreement with the club, that has been reviewed by an independent and qualified adviser and approved by the board (in line with paid secretaries) [Schedule 1, Section 4].
When do the changes come into effect?
The Registered Clubs Regulation 2025 comes into effect 1 September 2025.
All other provisions in the 2025 Regulation must be adhered to and will be enforceable from 1 September 2025.Under our Compliance and Enforcement Policy we take a graduated and proportionate compliance and enforcement approach.
