Night-Time Economy Accelerator for Councils (‘Accelerator’) – Participation Terms and Conditions
The Department of Creative Industries, Tourism, Hospitality and Sport as represented by the Office of the 24-Hour Economy Commissioner (O24HEC) will engage You in accordance with these Terms and Conditions.
Any reference in these Terms and Conditions to ‘You’ means Your council as detailed in the application form for the Accelerator.
By clicking ‘Accept’ you confirm that you have read and agree to the Accelerator Participation terms on behalf of your council.

Your obligations
- By participating in the Accelerator. You agree to:
- commit up to two of Your Participating Officers to the Accelerator’s full program schedule as set out in in the Accelerator Guidelines, including attending all mandatory events, whether in-person or online;
- be willing to work collaboratively with and support all Accelerator participants;
- comply with O24HEC’s reasonable requests for information, including:
- completing feedback forms to track Your progress during and after the Accelerator and to inform future Accelerator programs;
- participating in case studies prepared by O24HEC;
- providing images/videos that represent your night-time economy work, from your local government area; and
- providing a written testimonial about Your experience in the Accelerator,
- comply with the Accelerator Guidelines and these Terms and Conditions and immediately inform us if at any time you do not comply with them; and
- comply with any NSW Government and O24HEC policy, including any Code of Ethics and Conduct and Conflict of Interest policy, as and when You are notified by the O24HEC.
Costs
- Subject to clauses 3 and 4, You are responsible for all costs for Your Participating Officers’ involvement in the Accelerator, including:
- costs relating to any private meetings, events, or activities;
- travel and accommodation costs (including flights), parking, or any other costs associated with getting to or from the Accelerator (except where cited under item 4); and
- any additional or incidental costs such as phone and internet usage.
- As consideration for Your participation in the Accelerator, O24HEC will:
- not charge a participation fee; and
- provide Your Participating Officers with breakfast, lunch and dinner during the Bootcamp on 22-23 April 2026 .
- O24HEC may, in its sole discretion, agree to cover the following costs if You are a Regional NSW Council (as defined in clause 14):
- one-night’s accommodation on 22 April 2026 for each of Your Participating Officers to attend the in-person Bootcamp in Sydney. O24HEC will not cover any additional accommodation costs including, but not limited to, any costs for food, beverages, room upgrades or longer stays. If O24HEC incurs any additional costs because of Your Participating Officers’ use of the accommodation, O24HEC reserves the right to recover these costs from You;
- return airfares to Sydney for any Participating Officer who resides in location which is over 4 hours’ drive to Sydney to enable attendance of the in-person Bootcamp in Sydney. O24HEC will not cover any additional costs relating to travel including, including but not limited to, any costs for food, beverages, airport lounge access, or additional transport costs (taxis, rideshares).
- O24HEC may, in its sole discretion, agree to cover one night’s accommodation for any Participating Officer from the Greater Sydney region who can demonstrate that the travel time from their place of residence to the event (including any site visits) would exceed, on average, 90 minutes’ travel one way.
Copyright and confidentiality
- You agree to keep all Accelerator Materials which are made available to You (including Your Participating Officers) during the course of the Accelerator program participation confidential, other than as necessary to participate in the Accelerator, except for information within the public domain other than by reason of a breach of these Terms and Conditions, or as otherwise required by law.
- You acknowledge O24HEC or its licensors own all Intellectual Property Rights in the Accelerator Materials.
- To the extent You have any right, title or interest in any materials (including photographs) that has been developed independently of the Accelerator and that You make available to O24HEC for the purposes of the Accelerator, You grant O24HEC a royalty-free, non-exclusive and non-transferable licence to use those materials for the full benefit of the Accelerator (including promotion of the Accelerator) and for legitimate government purposes.
General terms
- Acknowledgement: You must not announce Your participation in the Accelerator without O24HEC’s written prior permission. If you wish to issue a media release, the proposed media release must be forwarded to lgp@24houreconomy.nsw.gov.au for O24HEC’s written approval at least 5 business days prior to its intended release. You must promptly remove our acknowledgement and logo from any Accelerator Material if we request it.
- Publicity: You acknowledge and agree that O24HEC may issue media releases in relation to Your participation in the Accelerator without providing prior notice to You. O24HEC reserves the right to identify Your council as the subject of publicity and for case studies.
- Privacy: O24HEC will manage any Personal Information it collects from You (including Your Participating Officers) in accordance with the Privacy and Personal Information Protection Act 1998 and DCITHS’ privacy policy. Where You provide Personal Information of Your Participating Officers or other personnel to O24HEC, You warrant that You have obtained all required consents from the relevant persons for such disclosure (including disclosures to third party service delivery partners engaged to deliver components of the Accelerator), in compliance with the Privacy and Personal Information Protection Act 1998 and you consent to O24HEC using this Personal Information as set out in the Accelerator Guidelines and these Terms and Conditions.
- Termination: If at any time during Your participation in the Accelerator You (including Your Participating Officers) fail to meet any of these Terms and Conditions, O24HEC may in its sole discretion immediately terminate Your participation in the Accelerator by way of written notice to you.
- Definitions: In these Terms and Conditions:
- Accelerator Guidelines means the document, Night-Time Economy Accelerator for Councils Guidelines¸ as amended from time to time, which is available here (PDF 4.22MB);
- Accelerator Materials: all content and materials that are created by or for O24HEC to deliver the Accelerator and during the course of the program, including any handouts, workbooks, slides, videos or other training and educational materials;
- Intellectual Property Rights mean all current and future registered and unregistered rights in respect of copyright, designs, circuit layouts, trademarks, trade secrets, know-how, confidential information, patents, invention and discoveries and all other intellectual property as defined in article 2 of the Convention establishing the World Intellectual Property Organization.
- Participating Officer means the one or two officers of Your Council which are named in your application form and which O24HEC has approved to attend and participate in the Accelerator;
- Personal Information has the meaning given under the applicable Privacy and Personal Information Protection Act 1998;
- Regional NSW Council means a council which is located in the local government areas that are identified in boundaries set out by the NSW Department of Planning, Housing and Infrastructure.
