Privacy collection notice for BCNSW eCert portal
Learn how Building Commission NSW (BCNSW) collects, uses, and protects your personal information under privacy laws when you register for and use the BCNSW eCert portal to submit Certificates of Compliance or Inspection.
Who we are
Your information is being collected by Building Commission NSW (BCNSW), as part of the Department of Customer Service (DCS).
Building Commission NSW gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).
Your information may also be collected by Service NSW on behalf of Building Commission NSW should you need to contact the helpline.

Why we collect your personal information
Building Commission NSW and Service NSW, as part of the Department of Customer Service, is collecting your personal information for the purpose of registering you for and administering your access to the BCNSW eCert portal.
From this portal, you can pay fees (if applicable) and submit compliance certificates in accordance with the Gas and Electricity (Consumer Safety) Act 2017 (G&E Act) and Gas and Electricity (Consumer Safety) Regulation 2018 (G&E Reg).
What personal information we collect
We may collect the following information:
- Your full name, contact details (address, email and phone number) and licence information (including state of registration).
- Third party information such as customer details including name, company name, email address, phone number and installation site address – provided the third party has given consent.
- Installation site address which could be a facility (for example hospital), property details or vehicle details.
- Tester or Technician details – for Electrical and Medical Gas Compliance Certificates, you may assign the testing or commissioning to another tradesperson, in that instance we will ask you for their licence details to validate (this is provided the third party has given consent).
Are you required by law to provide us with this information?
You are legally required to provide this information in order to meet your requirements under the Gas and Electricity (Consumer Safety) Regulation 2018. If you choose not to provide this information, you will not be able to meet these requirements and submit your Certificate of Compliance or Certificate of Inspection.
How we may use this information
We will use the personal information we collect about you:
- To verify your licence details so you can register in the BCNSW eCert portal and gain access to the services it offers.
- To assess the information and documents you provide in the portal and ensure the electrical, gasfitting or medical gas work conducted is compliant with the requirements of the G&E Act and G&E Reg.
- To process payments of fees (if applicable) in accordance with the type of installation performed.
- For internal administrative purposes, including liaising with you in relation to your submitted Certificates, and in relation to compliance, investigations, and enforcement of the G&E Act and G&E Reg. or any other relevant Acts and Regulations.
- In deidentified form, to support more informed policy making, program management, evaluation, research, and service planning.
- Other directly related purposes.
Who we may share your information with
We may disclose this information with the customer, an energy provider or network operator, a gas supplier, or other licence holders. This will usually occur in the following circumstances:
- For the customer and energy provider, to meet legislative requirements.
- Other licence holders – in the scenario where a licence holder installs but does not conduct the testing, this information would be made available to the tester.
We may disclose your personal information to other NSW Government agencies, other State or Territory governments, and the Commonwealth government for the purposes of your submitted Certificate of Compliance or Certificate of Inspection, and for compliance, enforcement and investigation purposes as required or authorised by law.
Other than as outlined above, we will not provide your personal information to anyone else unless we are authorised or permitted to do so by law or where you have given consent.

Protecting your information
We will store and manage your information in accordance with the provisions of the Privacy and Personal Information Protection Act 1998 and the Health Records and Information Privacy Act 2002. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
