Privacy collection notice for Swimming Pool Register
Learn how Building Commission NSW collects, uses and protects your personal information under privacy laws when you register for and use the Swimming Pool Register as a pool owner, certifier or council inspector.
Who we are
Your information is being collected by Building Commission NSW, as part of the Department of Customer Service (DCS).
Building Commission NSW gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act) and Health Records and Information Privacy Act 2002 (HRIP Act).

Why we collect your personal information
Building Commission NSW, as part of the Department of Customer Service, collects your personal information as part of the registration process for authorized users.
The purpose of the collection is to create an account to become an authorized user to input pool inspection details as required by Section 22 of the Swimming Pools Act.
What personal information we collect
We may collect the following information:
Pool owners:
- Address.
Registered Building Certifiers:
- Your full name
- Your email address
- Your certifier registration number
- Your registration expiry date.
Information provided should match the details shown on the Building Certifiers Public Register.
Council Inspectors:
- Your full name
- Your email address
- Council name.
Are you required by law to provide us with this information?
Providing us with the requested information is not required by law. However, if you choose not to provide us with the requested information, we may not be able to create an account in the register for you to carry out your legislative requirements.
How we may use this information
We will use the personal information we collect about you to carry out multi factor authentication, as an authorized user on the register. Information will also be used for:
- Internal administrative purposes, including liaising with you in relation to the swimming pool register, and in relation to compliance, investigations, and enforcement of the Swimming Pool Act 1992 & Swimming Pool Regulation 2018 or any other relevant Acts and Regulations.
- To record information on a public register which is published online, as required by Swimming Pool Act 1992 & Swimming Pool Regulation 2018 or any other relevant Acts and Regulations.
- In deidentified form, to support more informed policy making, program management, evaluation, research, and service planning.
- Other directly related purposes.
Who we may share your information with
If required, we may disclose your personal information to other NSW Government agencies, local council agencies or other States, Territories and/or the Commonwealth government for the purposes of any compliance, enforcement and investigation purposes as required or authorised by law.
Unless stated otherwise, we will not disclose your personal information to any other party, unless we are authorised or permitted to do so by law or where you have given consent.

Protecting your information
We will store and manage your information in accordance with the provisions of the Privacy and Personal Information Protection Act 1998 and the Health Records and Information Privacy Act 2002. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes, we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
