Building Work Rectification Order for Australia YMCI Pty Ltd

Section 33 of the Residential Apartment Buildings (Compliance and Enforcement Powers) Act 2020

Summary of Order

• Australia YMCI Pty Ltd (ACN 607 884 711) (Developer) is issued this Building Work Rectification Order (Order) in relation to Class 2 residential apartment buildings located at Lidcombe (being the three properties known as “Emerald”- 2 Kingfisher St, Lidcombe, “Ruby”- 1 Kingfisher St, Lidcombe, and “Sapphire”- 2 Honeyeater St, Lidcombe, and which comprise the development known as “Ovation Quarter" registered as Stratum Lot 2 Deposited Plan 1260687: Strata Plan 101327 [Emerald], Strata Plan 101328 [Ruby] and Strata Plan 101329 [Sapphire] (together, Buildings).
• The Developer is required to cause building work to be carried out to remediate the serious defects as set out in “Attachment 1 – Defect List” in this Order. The serious defects are the same serious defects as agreed by the Developer in the undertaking given on 20 July 2022 under section 28 of the Residential Apartment Buildings (Compliance and Enforcement Powers) Act (the Undertaking) in respect of the Buildings. The Developer has part performed the obligations on the Developer under the Undertaking but there are serious defects remaining to be remediated. The serious defects as set out in Attachment 1 of this Order is the list of serious defects identified pursuant to the Undertaking but excluding those defects which have been remediated.
• This Order must be complied with within the period of 12 months that is, by 22 December 2026.
