Register of Government Contracts
The Government Information (Public Access) Act 2009 (GIPA Act) requires certain information about contracts that the Department enters into valued at $150,000 (inclusive GST) or more be recorded in a register of government contracts, which is available at Buy NSW Register of Notices.
Details of each contract must be entered into the register within 45 working days of coming into effect, and must remain on the register for whichever is the longer of the following periods:
- 20 working days, or
- until the contract is complete, the goods and services concerned have been provided under the contract, the term of the lease has expired, or the real property has been transferred.
Class 3 contracts
Class 3 contracts that have, or are likely to have, a value of $5 million or more, and are subject to further disclosure requirements.
Under the GIPA Act, a copy of each class 3 contract is required to be made publicly available.
However, the register is not required to include:
- the commercial-in-confidence provisions of a contract,
- details of an unsuccessful tender,
- any matter that could affect public safety or security, or
- a copy of a contract, a provision of a contract or any other information in relation to a contract that is of such a nature that its inclusion in a record would result in there being an overriding public interest against disclosure of the record.
