Legislative framework
The legislative framework for operations of the NSW Biodiversity Conservation Trust is set by the Biodiversity Conservation Act 2016, the Biodiversity Conservation Regulation 2017 and the Biodiversity Conservation (Savings and Transitional) Regulation 2017.
Biodiversity Conservation Act 2016 (NSW)
Part 10 of the Biodiversity Conservation Act 2016 formally constitutes the NSW Biodiversity Conservation Trust and outlines its functions and governance.
The Act provides the framework for:
- Conservation agreements with private landholders.
- How biodiversity impacts from development are assessed and offset.
- Management of the Biodiversity Conservation Fund and Biodiversity Stewardship Payments Fund.
Supporting legislation helps ensure consistency, transparency and continuity in how conservation agreements are managed.

Legacy agreements
To ensure long-term conservation outcomes, the NSW Biodiversity Conservation Trust also administers legacy agreements made under earlier legislation, including:
- Nature Conservation Trust Act 2001
- Threatened Species Conservation Act 1995
- Native Vegetation Act 2003
- Relevant parts of the National Parks and Wildlife Act 1974
