NSW FAIR TRADING INFORMATION ACCESS FORM - PRIVACY COLLECTION NOTICE
1. Who we are
Your information is being collected by the Department of Customer Service (the Department) on behalf of the Commissioner for NSW Fair Trading. NSW Fair Trading gives priority to protecting the privacy of your personal information, in accordance with the Privacy and Personal Information Protection Act 1998 (PPIP Act).

2. Why we collect your personal information
NSW Fair Trading is collecting your personal information for the purposes of processing your formal application for information pursuant to Part 4 of the Government Information (Public Access) Act 2009 (the GIPA Act).
3. The kinds of information we collect
We may collect the following information:
- Your full name and contact details (including your address, phone number and email address).
- Proof of identity information, which may include your photo identity documents, like a passport, driver licence or Government issued identity card.
- Third-party information, such as the name of the party who you act on behalf of (if applicable) and their authorisation
- Details of the information being requested
- If applying for a discount of the processing fees, proof of special interest and/or financial hardship, such as a pension card.
- Supporting documentation
- Additional personal information if it is required to process your access application or identify the information being sought.
4. Failure to provide information
Your information is provided voluntarily, however, if you choose not to provide your information, we may be unable to process your application.
5. How we may use this information
We may use the information we collect in the following ways:
- To process your application for information under Part 4 of the Government Information (Public Access) Act 2009.
- Internal administrative purposes, including liaising with you in relation to your application.
- To support more informed policy making, program management, evaluation, research, and service planning as it can facilitate more efficient service delivery for residents and business in NSW.
- Other directly related purposes.
6. Who we may share your information with
In accordance with Part 4 Division 2 of the GIPA Act, your access application may be transferred to another agency either in full or in part if the information being sought relates more closely to the functions of another agency. If required, your personal information will be disclosed during the transfer to allow the other agency to process your GIPA application.
In accordance with Part 4 Division 3 of the GIPA Act, we may need to consult with third parties before deciding your GIPA application. We may disclose your identity as the GIPA applicant during third party consultation, if you consent to this on the GIPA application form.
We will not disclose your information to anybody else unless we are authorised or permitted to do so by law or where you have given consent. For further information, please see our Privacy Statement.
7. Protecting your information
We will store and manage your information in accordance with the provisions of the PPIP Act. We have measures in place to help protect your personal information from loss, unauthorised access, use, modification, disclosure, or other misuse.
We will only keep information for as long as we need it to fulfil the purposes we collected it for. After which, the information will be disposed of securely in accordance with the State Records Act 1998 and any other applicable legislation.
