Enforceable undertakings register
Enforceable undertakings are legally binding agreements between NSW Fair Trading and someone who has allegedly committed an offence and not followed the law.
About enforceable undertakings
Enforceable undertakings are one of the compliance tools used by NSW Fair Trading to ensure a fair and competitive market in NSW. They are an agreement between a person (or regulated entity) and NSW Fair Trading.
The reasons for entering into an undertaking will vary depending on the legislation that is relevant to the matter. The terms will also vary, as will the methods of enforcing the undertaking.
Legislation under which NSW Fair Trading may agree to enforceable undertakings includes:
- Australian Consumer Law (located in Schedule 2 of the Competition and Consumer Act 2010 (Cth))
- Charitable Fundraising Act 1991 (NSW)
- Community Gaming Act 2018 (NSW)
- Conveyancers Licensing Act 2003 (NSW)
- Co-operatives (Adoption of National Law) Act 2012 (NSW)
- Fair Trading Act 1987 (NSW)
- Motor Dealers and Repairers Act 2013 (NSW)
- Property Stock Agents Act 2002 (NSW).
