The NSW Fair Trading Name and Shame Register helps owners, renters, buyers and sellers make informed choices when selecting a property agent. It is part of NSW Fair Trading’s commitment to a fair and safe marketplace for goods, services and homes in NSW.

About the register

The NSW Fair Trading Name and Shame Register publishes regulatory actions taken against real estate agents, strata managing agents and stock and station agents for breaches of NSW property laws, with publication permissible under the Fair Trading Act 1987 (FT Act).

Publishing this information increases transparency, deters wrongdoing and helps ensure confidence in the property, strata and rental sectors.

The information in this register relates to the property, rental and strata sector. Other sectors regulated by NSW Fair Trading will be considered and added in the future.

What's published

Actions that can be listed include:

  • disciplinary actions
  • licence suspension or cancellation
  • public warnings
  • undertakings
  • prosecution outcomes
  • high risk penalty notices.
     
How information is published on the register

Information about regulatory actions such as disciplinary actions, cancellation, suspension or disqualification of licences, public warnings and prosecution outcomes will be published on the Name and Shame Register.

The approach taken by NSW Fair Trading in determining the information that will be published on the register reflects the seriousness of the circumstances surrounding the regulatory action, including the likelihood of risk to consumers and the need to protect consumers from future harm from similar actions being taken by traders.

In the case of penalty notices, information about high risk penalty notices will be published on the Name and Shame Register. This reflects the risk of consumer harm and the seriousness of the breach of legislation.

NSW Fair Trading may also publish information about other penalty notices if there is a pattern of continued misconduct or a risk of significant consumer harm.
