Consumers warned not to deal with Smartware Pty Ltd
NSW Fair Trading is warning consumers not to deal with Smartware Pty Ltd, which operates the website "https://mifo.com.au" and brands itself as “mifo Australia’s best electronics”.
Smartware Pty Ltd is a registered Australian company that advertises on its website small electrical appliances such as earbuds, speakers and robotic vacuums.
Since 2020, NSW Fair Trading has received 195 complaints against Smartware Pty Ltd. Consumers complain that Smartware Pty Ltd has accepted payment for goods via its website and not supplied the goods ordered within a reasonable timeframe or at all, or otherwise supplying goods that are of poor quality which cease to operate immediately or very soon after first use.
Consumers have reported finding it difficult to contact Smartware Pty Ltd to follow up on refunds after goods have been returned, and there does not appear to be an effective complaint handling process, making it difficult for urgent concerns to be resolved.
Consumers complain that Smartware Pty Ltd does not offer appropriate financial redress.
The terms of service and refunds and returns policies as set out on its website contain terms that are contrary to the Australian Consumer Law.
