1. Background
Tenants can expect Homes NSW to maintain a property in a reasonable state of repair, Homes NSW will also install and maintain compliant window locks.
To provide a means for securing properties from unauthorised entry through a window, Homes NSW has installed key window locks to all openable windows.
Checking key window locks is required to ensure the locks are functioning and lockable in ventilating positions. This occurs during Property Assessment Survey (PAS) inspections and when a property is vacant.
2. Scope
This policy applies to properties managed by Homes NSW. This policy does not apply to headleased properties.
3. Business rules
Window locks in Homes NSW properties must comply with Homes NSW's Component Requirements, Australian Standards and the National Construction Code. Window locks when installed are to be keyed alike in accordance with the Component Requirements.
Homes NSW will install, maintain and replace key window locks in response to:
- a tenant requests
- vacant maintenance
- a staff or contractor report of a potential risk situation
- a dwelling's inclusion in a planned Program of Works.
Opening windows in newly constructed dwellings are fitted with keyed window locks.
Tenants are expected to advise Homes NSW when:
- Installed window locks are not operational, this includes lost keys. Deliberate damage to key window locks may result in tenant charges.
- There is a risk for children residing in upper floor units in the absence of window locks.
4. Legislation and compliance
Homes NSW will install, maintain and replace key window locks in accordance with:
- The Residential Tenancies Act 2010
- The Residential Tenancies Regulation 2019
- The terms of the residential tenancy agreement
- Homes NSW Policies
Both the tenant and Homes NSW have rights and obligations under the Residential Tenancies Act 2010, the residential tenancy agreement and Homes NSW policies.
