Better Regulation Statements (BRS) and Regulatory Impact Statements (RIS) provide information on the economic, social, and environmental impacts of a proposed regulation as compared with other options. This enables informed decision-making and assures the community that regulations are made to promote the public interest.
A BRS must be prepared for all significant new and amending regulatory proposals to document the application of the Government’s better regulation principles, as outlined in the NSW Government Guide to Better Regulation (TPP19-01 and TC19-02).
A RIS is generally required when a principal regulation is made, or when regulation is remade under the staged repeal provisions of the Subordinate Legislation Act 1989. The requirements for RIS are outlined in the Act. A RIS may be submitted in place of a BRS, however it should also meet the better regulation principles.
