These Guidelines have been published to ensure greater certainty, consistency, fairness, transparency and accountability about:
• the basis on which the Inspectorate will make a decision to prosecute; and
• the factors the Inspectorate will take into account in deciding which charges to lay.
The State Compliance Unit (SCU) is a unit within the New South Wales Industrial Relations (NSW IR) Inspectorate. The purpose of this Policy is to outline:
• the SCU’s functions in relation to complaints;
• the framework used by the SCU for assessing, investigating, and concluding complaints received; and
• relevant complaint management standards maintained by the SCU.
The Strategic Investigations Team (SIT)) is a unit within the New South Wales Industrial Relations (NSW IR) Inspectorate. The purpose of this Policy is to outline:
• the SIT’s functions with respect to investigation, compliance and enforcement actions; and
• the framework for investigating and concluding investigations undertaken by the SIT.
