Financial management appointments
A financial manager is appointed by a court or tribunal to manage a person's property and affairs when they cannot do so for themselves. Read more to understand how they are appointed.
How is an appointment made?
In NSW, an appointment of a financial manager is made by either the Supreme Court of NSW, the NSW Guardianship Division of the NSW Civil and Administrative Tribunal (NCAT) or the Mental Health Review Tribunal.
In relation to litigation proceedings for injury claims in either the common law division of the District Court of NSW or the Supreme Court of NSW, the NSW Mental Health Review Tribunal will not be a forum through which to apply for a financial management order. It is important to note that NCAT does not have the power to authorise the remuneration of a private manager. For an explanation of the recommended route for a financial management order when dealing with personal injury awards, refer to the paper titled ‘The Incapacitated Plaintiff and Personal Injury Compensation Proceedings’ presented by Lindsay J for the NSW Bar Association Personal Injury and common law conference 11 March 2017 at: The Incapacitated Plaintiff.15.3.17.REVISED
