The updated NSW Non-government Schools Not For Profit Guidelines (NFP Guidelines) have now been released to help schools better understand and comply with the not for profit requirements set out in the Education Act 1990 (NSW) (the Act).
These updates align with the recommendations from the Review of Section 83C and related provisions of the Education Act 1990 (NSW) report, and changes to the Education Regulation 2017 (NSW) (Regulation) that took effect in December 2025.
The updated NFP Guidelines strengthen transparency, accountability and confidence in how public funding is used across the non-government school sector. They clarify NESA’s role in assuring that school expenditure is for the operation of the school.
Key changes include:
- a refreshed structure and design
- reduced repetition
- clearer guidance and examples to help schools understand how to comply.
The NFP Guidelines are now available in a HTML format to enhance navigation and usability. This format enables schools to easily locate the guidance they need on the nsw.gov.au/NESA website and via the website search function. The NFP Guidelines are also available for download as a PDF.
Schools are encouraged to review the NFP Guidelines promptly as part of their ongoing governance and compliance arrangements.
