Part B4: Not for profit requirements – Governing body members
B4.1 Payments to governing body members
A school will operate for profit if it makes a payment to a person in connection with the person’s activities as a member of the governing body of the school, unless the payment is in reimbursement for a payment made by the person in connection with the operation of the school (Section 83C(2)(c) of the Education Act).
Where a member of the governing body also holds another position in the school e.g. they are also a teacher or a business manager, they should be remunerated exclusively for their employment within the school and not their position on the school governing body.
In special, one-off circumstances where schools wish to provide a gift to a governing body member, any such gift should be of nominal value and documented as part of the financial and governance records.
- Records of all payments made to members of the school’s governing body, along with supporting receipts.
- An employment contract and/or statement of duties for any other paid role in the school held by the school governing body member.
