E1. Understanding relevant laws
E1 lists the laws and regulations relevant to teacher accreditation.
E1.1 Relevant law
E1.1.1 NESA accredits teachers under the Teacher Accreditation Act
NESA accredits teachers under:
- the Teacher Accreditation Act 2004 (TA Act) that governs the accreditation of school and early childhood teachers (sections 19–42B)
- the Education Standards Authority Act 2013 (NESA Act).
E1.1.2 Other laws and regulations support teacher accreditation
In addition to the requirements of the TA Act, schools and services must be aware of, understand and comply with other relevant Commonwealth and state legislation.
The following acts and regulations are relevant for teacher accreditation, although the list is not exhaustive. Schools and early childhood employers are advised to check this information with the appropriate source to ensure its accuracy, relevance and currency.
- Education Act 1990 (NSW)
- Children (Education and Care Services National Law Application) Act 2010
- Teacher Accreditation Regulation 2023 (TA Regulation)
- Australian Professional Standards for Teachers (the Standards)
- Trans-Tasman Mutual Recognition Act 1997 (NSW) (TTMR Act)
- Mutual Recognition Act 1992 (Commonwealth) (MR Act)
- Child Protection (Working with Children) Act 2012
- Children’s Guardian Act 2019.
