In order that consistency is maintained in mutual cancellation arrangements, the attached application form and procedure details the process for dealing with the cancellation of an apprenticeship or traineeship.
A training contract may be cancelled by the mutual and voluntary agreement of both the employer and the apprentice or trainee (the parties) to the training contract. Before agreeing to a mutual cancellation the parties should be encouraged to seek advice and assistance from an Industry Training Officer with Training Services on the cancellation procedure.
The attached Application to Cancel an Apprenticeship or Traineeship by consent form, provides a means by which the parties may formally cancel a training contract and meet their obligations under Section 22 of the Apprenticeship and Traineeship Act, 2001 (A&T Act) by notifying the Commissioner. Applications to cancel should not be made until some attempt has been made to consider options to continue the training arrangement.
Both parties should sign the form to indicate their consent to the proposed cancellation, where it is not practicable for the parties to use the same form the parties may prepare a similar advice provided all necessary details required to legally cancel the training contract are included in such notice prepared by the parties.
If one party is unavailable to sign, the form may be submitted with only one signature. In such cases, the reasons for the absence of the other party’s signature must be clearly stated in the comments section.
If either party does not agree to the cancellation of the training contract they should seek immediate assistance from Training Services. Neither party should be forced to agree to the cancellation of the training contract as a result of undue pressure or coercion.
Note: An incomplete, or illegible, form lodged by either party to a Training Contract is not acceptable as notice of cancellation under Section 22 of the Apprenticeship and Traineeship Act, 2001 and will be returned for completion by Training Services.
