Managing employer returns in the building and construction industry
Find out how to complete and submit service returns for your workers if you are an employer in the building and construction industry in NSW.
What is a service return?
A service return is a list of workers that Long Service Corporation (LSC) has recorded as being employed by you. This list is compiled from the Start Notices and End Notices you have lodged in the previous financial year(s).
What employers must do
If you employ a worker to do building and construction work in NSW, you are legally required to:
- confirm the service details of eligible workers
- update their service record.
Confirming and updating their service ensures benefits paid in the scheme are calculated accurately.
Employers must complete service returns each year:
- by 31 July, and
- on the Employer Portal.
Informing LSC about a worker's service
LSC will send employers information on how to complete their service returns in the first week of July each financial year. Returns are due by 31 July.
A few things to note about the return:
- If a worker is shown on the return that you no longer employ, or the worker is no longer doing eligible work, there is a place on the return to tell us what date the worker was terminated.
- If a worker you employ is not on the return, you must submit a Start Notice through the Employer Portal.
- Where a worker performs a combination of eligible and ineligible work, they should be recorded as part time. Service credits should only be submitted where they perform eligible building and construction work for more than half their ordinary workday.

Employers who don't complete service returns
Non-compliant employers will be identified and receive a Statement of Obligations notice.
LSC will issue a Notice of Inspection if an employer:
- fails to respond to the Statement of Obligations notice, or
- does not complete a return by 31 August.
In the Notice of Inspection, we will note the specific time and place where we will conduct an inspection of records and documents to verify worker service.
