Employer eligibility requirements for the community services industry long service scheme

About eligibility for the scheme
If you employ one or more people to carry out community service work, you must register for the community services industry portable long service leave scheme (the scheme).
You are required to carry out a further assessment to determine how many of your workers will be covered by the scheme. We call this assessment the 'predominant purpose' test.
Our assessment will help you determine:
- the predominant purpose of your organisation
- how many of your workers will be covered by the scheme.
If the predominant purpose of your organisation is:
- to provide a community service, you must register all your workers, whether they do community service work or not
- not to provide a community service, you only need to register the service of those workers who do community service work.

Keep the documentation from your assessment
If the assessment shows you are eligible, you will be required to register with us. After you register, your organisation may be asked:
- to provide supporting documentation, or
- to participate in compliance reviews.
Supporting documentation
Registered employers may be asked to substantiate their self-assessment with the following information:
- governing documents such as a constitution or articles of association
- annual reports outlining service delivery operations
- organisational charts illustrating workforce composition data
- service delivery reports or impact statements
- worker role descriptions
- operational policies and procedures
- Australian Charities and Not-for-profits Commission and/or company registration details (if applicable).
Compliance reviews
Long Service Corporation (LSC) may conduct compliance reviews with registered employers to verify your eligibility for the scheme. Reviews may include:
- requests for information
- random audits, and
- targeted investigations where required.
Organisations based outside NSW
If your organisation is based outside NSW, you still may be required to participate in the scheme.
Regardless of whether your organisation has offices in NSW, you are required to register with LSC if you:
- employ workers who perform eligible community services work in NSW
- take the assessment and it shows you need to register.
