What’s this about?
The Department of Communities and Justice is conducting a statutory review of the performance crime offence in section 154K of the Crimes Act 1900on behalf of the Attorney General.
The performance crime offence is available where:
- an act or omission of the offender constitutes a motor theft offence or a breaking and entering offence, and
- the offender disseminates material to advertise their involvement in the offence, or the act or omission constituting the offence.
Under section 154L of the Crimes Act, the statutory review must determine whether the policy objectives of the offence remain valid, and whether its terms remain appropriate for achieving those objectives.
DCJ has prepared an Information Sheet that provides background information on the elements and policy objectives of the offence, and statistics from the NSW Bureau of Crime Statistics and Research (BOCSAR) showing its operation.
DCJ is seeking your views on the performance crime offence to inform our statutory review.
