Selling property in NSW
Learn how to sell your property in NSW, with or without an agent. Understand contracts, agency agreements, and your legal obligations.
If you're planning to sell a property in NSW, it's important to understand the process and your legal responsibilities.
Selling with an agent
When using a licensed real estate agent, you must:
- sign a written agency agreement outlining the agent's services, fees, and estimated selling price
- ensure the agent provides evidence supporting their estimated selling price, based on factors like comparable sales and market conditions
- be aware of underquoting laws, which prohibit advertising a property below the agent's estimated selling price.
Legal requirements
Regardless of your selling method, you must:
- have a contract of sale prepared by a lawyer or a licensed conveyancer before advertising the property
- disclose any known issues with the property, such as defects or encumbrances
- provide necessary certificates, for example, a valid swimming pool compliance certificate, if applicable.
