Swimming pools and pool safety in public housing
Homes NSW tenants can apply to install above-ground, inflatable, or portable pools but must follow safety regulations and obtain approval from both Homes NSW and the local council.
NSW Fair Trading has information about safety and inflatable pools, spa pools, swimming pools and fencing requirements.
Installing a pool in your home
You can apply to install a permanent above-ground, or an inflatable or portable pool in your backyard. In-ground swimming pools, or pools in a common area are not allowed.
How to get approval for an above-ground pool
To get approval for an above-ground pool you must:
- Contact your client service officer to request approval.
- Homes NSW inspect your property to assess the impacts.
- Obtain council approval and receive a development consent and construction certificate.
- Submit development consent and construction certificate to Homes NSW.
- Obtain Homes NSW approval letter.
- Once the pool is installed, send us the pool registration certificate and compliance/occupation certificate.
If you already have an in-ground or permanent above ground pool on your property, it must be approved by us and your local council.
If we have not approved the pool, please contact your client service officer immediately, as you are in breach of the terms of your Tenancy Agreement and the Swimming Pools Act 1992.
If the breach is not addressed, we may commence action against your tenancy in the NSW Civil and Administrative Tribunal (NCAT).
How to get approval for an inflatable or portable pool
To get approval for an inflatable or portable pool you must:
- Notify your client service officer of your pool installation.
- Send Homes NSW a registration certificate.
- Obtain letter from Homes NSW outlining responsibilities as a pool owner.
If you already have an inflatable or portable pool you must notify us immediately and provide a copy of the registration certificate.
