Details of planning clearing

You can provide a map or shapefile to show the location of proposed clearing. To do this, reply to the confirmation email you receive after submitting this form and attach any required documentation to support your notification.

List all the Lot/DPs on which you intend to clear native vegetation.

The first date of intended clearing must be at least 2 weeks following a valid notification.

A valid notification must be:

  1. within the required timeframe, and
  2. in the form and manner of this notification form.

If the form is incomplete or requires additional information, the date of the valid notification will be the date on which all required information is received. 

Are the species to be cleared listed as invasive for the relevant region?

Conditions

For this notification to be valid, you must confirm that you meet the following conditions under the Code.

  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing
    • is not subject to a private native forestry plan
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code)
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand that clearing is limited to methods that are likely to cause no more than minimal disturbance to soil and groundcover.
  • I understand that any clearing within Category 2 – vulnerable regulated land must cause no more than nil disturbance to soil and groundcover.
  • I understand that clearing of trees and shrubs that are non-invasive native species is permitted only to the minimum extent necessary and must not exceed 10% of the total number of trees and shrubs cleared from the treatment area.
  • I understand the requirements for the number and size of species that must be retained (if using methods other than burning).
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • To the best of my knowledge (after checking the land titles for all listed lot/dps), there are no existing title restrictions, covenants or caveats on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2026, and the Land Management (Native Vegetation) Code 2018.
  • Have you considered any obligations or approvals you may need for this proposal under the Australian Government's Environment Protection and Biodiversity Conservation Act 1999 in terms of possible significant impacts on Matters of National Environmental Significance (MNES)? 
    Note: Landholders are responsible for self-assessing whether they need to refer their activities under national environmental law. A notification of intent to clear native vegetation under the NSW Local Land Services Act 2013 does not exempt you from possibly requiring approval under the EPBC Act. Conditions

For this notification to be valid, you must confirm that you meet all the following conditions under the Code. 

Refer to the guide on Pasture expansion under the Land Management Code for an explanation of these conditions or for more information.

  • My landholding is not a small holding (as defined by the Local Land Services Act 2013).
  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing
    • is not subject to a private native forestry plan
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code)
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a a vulnerable ecological community, endangered ecological community, or critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand that clearing is limited to methods that are likely to cause no more than minimal disturbance to soil and groundcover.
  • I understand that any clearing carried out on Category 2 – vulnerable regulated land or within the buffer distance from a water body may only be by clearing individual plants with nil disturbance to soil and groundcover.
  • Each intended clearing area is not less than 1 hectare in size.
  • I understand that the minimum density of retained native trees and shrubs is at least 225 stems per hectare and, as far as reasonably possible, they are to be at least 2 m in height and evenly spread throughout the treatment area.
  • I understand that all native trees with a diameter at breast height over bark greater than 90 cm must be retained.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • To the best of my knowledge (after checking the land titles for all listed lot/dps), there are no existing title restrictions, covenants or caveats on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2026, and the Land Management (Native Vegetation) Code 2018.
  • Have you considered any obligations or approvals you may need for this proposal under the Australian Government's Environment Protection and Biodiversity Conservation Act 1999 in terms of possible significant impacts on Matters of National Environmental Significance (MNES)? 
    Note: Landholders are responsible for self-assessing whether they need to refer their activities under national environmental law. A notification of intent to clear native vegetation under the NSW Local Land Services Act 2013 does not exempt you from possibly requiring approval under the EPBC Act. A ‘paddock tree area’ means an area of Category 2 – regulated land that is less than 500 square metres and is completely surrounded by Category 1 – exempt land.
The number cannot exceed 1 per 50ha of landholding.

  • All areas to be cleared meet the definition of paddock tree areas.
  • My landholding is not a small holding (as defined by the Local Land Services Act 2013).
  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land
    • is not entirely or partly on Category 2 – vulnerable regulated land or within the buffer distance from a water body
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing
    • is not subject to a private native forestry plan
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code)
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land)
    • does not contain native vegetation that forms part of a critically endangered ecological community.
    • does not contain Crown land within the meaning of the Crown Lands Act 1989 and is reserved or dedicated for the purposes of a travelling stock reserve within the meaning of the Local Land Services Act 2013 if located in the Coastal or Central Zone.
  • The landholding has more than 10% Category 2 – regulated land on it, and the clearing I am intending to undertake will not reduce it to below 10%.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand clearing is not permitted if a critically endangered species (plant or animal) is present.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • To the best of my knowledge (after checking the land titles for all listed lot/dps), there are no existing title restrictions, covenants or caveats on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2026, and the Land Management (Native Vegetation) Code 2018.
  • Have you considered any obligations or approvals you may need for this proposal under the Australian Government's Environment Protection and Biodiversity Conservation Act 1999 in terms of possible significant impacts on Matters of National Environmental Significance (MNES)?

    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code)
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand clearing is not permitted if a critically endangered species (plant or animal) is present.
  • The intended clearing area does not contain any areas where native species comprise more than 50% of the vegetation cover.
  • Percentages of compromised groundcover have been calculated according to the rules required by the Code.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • To the best of my knowledge (after checking the land titles for all listed lot/dps), there are no existing title restrictions, covenants or caveats on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2026, and the Land Management (Native Vegetation) Code 2018.

  • verify you as the owner of a landholding (the landholder), or someone authorised to act on behalf of a landholder
  • assess your application, including contacting you about your application, and administering any subsequent agreements entered into under the Land Management (Native Vegetation) Code 2018 (the Code)
  • confirming or updating your contact details on file with Local Land Services and advise you of relevant information regarding Local Land Services Land Management activities.

Additional information may be collected as part of the survey/review process which will be used when   assessing your application.   

How will we share your information?

We may share your information to the NSW Department of Climate Change, Energy, Environment and Water (NSW DCCEEW) for the following reasons authorised under the Local Land Services Act 2013 and the Local Land Services Regulation 2026:  

  • notification to the NSW DCCEEW Map Review Team of new Code authorisations to inform refinements to the Native Regulatory Vegetation Map (NVRM), per Part 5A, Division 2 of the LLS Act
  • upon request by the NSW DCCEEW Map Review Team (or applicant) in assessing Landholder Initiated Map Reviews (LIMR) of the NVRM, per Part 6, Division 2 of the LLS Regulation. We will not share it with anyone else unless you give your consent, or the law requires or allows us to do so.

PART B: Consent for Local Land Services to attend landholding and disclose landholding data              

Local Land Services may be required to enter your property to undertake the following activities necessary when processing your Code application, including:  

  • undertaking on-site vegetation surveys associated with your chosen Code application type
  • picking plant samples (ie. parts of or whole specimens, and only under a current and valid NSW DCCEEW Scientific Threatened Species License) for the purposes of: 
    • identifying native versus non-native vegetation
    • identifying the most appropriate or ‘best fit’ Plant Community Type (PCT)
    • identifying vulnerable or endangered/threatened species or vegetation communities; or critically endangered species or Critically Endangered Ecological Communities (CEEC).

Local Land Services may disclose or share components of this landholding information (including, but not limited to photographs of plant specimens, field data survey sheets, GPS point location data and parts of or whole plant specimens) with the National Herbarium of NSW (Part of the Royal Botanic Gardens, Sydney) for the purposes of identifying unknown plant specimens and updating relevant databases. 

Local Land Services may also be obligated to disclose or share components of this landholding information (including, but not limited to photographs of plant specimens, field data survey sheets, GPS point location data and parts of or whole plant specimens) upon formal requests from other relevant government agencies, including: 

  1. NSW DCCEEW for the purposes of updating the Bionet® Threatened Species database
  2. other agencies or entities for the purposes of improved plant and plant community identification, mapping, environmental protection and conservation and threatened species policy development under section 6(1)(b) of the Data Sharing (Government Sector) Act 2015.

Notes:  

  • Local Land Services officers will communicate with you in writing if any of the types of disclosures listed above in Part B are required. 
  • Any disclosure of personal or non-personal (landholding) information to NSW DCCEEW Compliance by Local Land Services is done upon formal request by NSW DCCEEW Authorised Officers for an active native vegetation compliance investigation per interaction of the Biodiversity Conservation Act 2016 and Part 5A of the Local Land Services Act 2013.
