Use this form to notify Local Land Services that you intend to clear vegetation under the Land Management (Native Vegetation) Code 2018.

There are several pathways for clearing native vegetation on rural land in NSW under the Land Management (Native Vegetation) Code 2018.

Your landholding may include several parcels of land that are worked as a single property or considered to be a single landholding.

Local Land Services must be satisfied that the primary use of the land is for genuine agricultural purposes. 
A Land Management officer will contact you to discuss your notification. 
After submitting this online form, you will have the option to send written evidence of agricultural use.

Details of planning clearing

You can provide a map or shapefile to show the location of proposed clearing. To do this, reply to the confirmation email you receive after submitting this form and attach any required documentation to support your notification.

List all the Lot/DPs on which you intend to clear native vegetation.
The first date of intended clearing must be at least 2 weeks following a valid notification.
Are the species to be cleared listed as invasive for the relevant region?
Refer to the invasive native species list for your region for more information. 

Conditions

For this notification to be valid, you must confirm that you meet the following conditions under the Code. 

Refer to the guide on Invasive native species under the Land Management Code for an explanation of these conditions or for more information.

  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land.
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing.
    • is not subject to a private native forestry plan.
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code).
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand that clearing is limited to methods that are likely to cause no more than minimal disturbance to soil and groundcover
  • I understand that any clearing within Category 2 – vulnerable regulated land must cause no more than nil disturbance to soil and groundcover.
  • I understand that clearing of trees and shrubs that are non-invasive native species is permitted only to the minimum extent necessary and must not exceed 10% of the total number of trees and shrubs cleared from the treatment area.
  • I understand the requirements for the number and size of species that must be retained (if using methods other than burning).
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2014, and the Land Management (Native Vegetation) Code 2018.
Keith formation to be cleared

Conditions

For this notification to be valid, you must confirm that you meet all the following conditions under the Code. 

Refer to the guide on Pasture expansion under the Land Management Code for an explanation of these conditions or for more information.

  • My landholding is not a small holding (as defined by the Local Land Services Act 2013).
  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land.
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing.
    • is not subject to a private native forestry plan.
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code).
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a a vulnerable ecological community, endangered ecological community, or critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand that clearing is limited to methods that are likely to cause no more than minimal disturbance to soil and groundcover
  • I understand that any clearing carried out on Category 2 – vulnerable regulated land or within the buffer distance from a water body may only be by clearing individual plants with nil disturbance to soil and groundcover.
  • Each intended clearing area is not less than 1 hectare in size.
  • I understand that the minimum density of retained native trees and shrubs is at least 225 stems per hectare and, as far as reasonably possible, they are to be at least 2m in height and evenly spread throughout the treatment area.
  • I understand that all native trees with a diameter at breast height over bark greater than 90 cm must be retained.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2014, and the Land Management (Native Vegetation) Code 2018.
The number cannot exceed 1 per 50ha of landholding.

Conditions

  • All areas to be cleared meet the definition of paddock tree areas.
  • My landholding is not a small holding (as defined by the Local Land Services Act 2013).
  • The land I am intending to clear:
    • is not Category 2 – sensitive regulated land.
    • is not entirely or partly on Category 2 – vulnerable regulated land or within the buffer distance from a water body.
    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing.
    • is not subject to a private native forestry plan.
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code).
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
    • does not contain native vegetation that forms part of a critically endangered ecological community.
  • The landholding has more than 10% Category 2 – regulated land on it, and the clearing I am intending to undertake will not reduce it to below 10%.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand clearing is not permitted if a critically endangered species (plant or animal) is present.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2014, and the Land Management (Native Vegetation) Code 2018.
Confirm you have the following groundcover calculation records:
You must hold these records for at least 5 years after the clearing of native vegetation.

    • does not contain native vegetation that was grown or preserved with public funds (other than funds for forestry purposes) where the obligations attached to the receipt of that funding are ongoing.
    • is not subject to a private native forestry plan.
    • is not for forestry operations within the meaning of section 3 of the Forestry Act 2012. (This does not prevent the sale of timber from native vegetation lawfully cleared in accordance with the Code).
    • is not already a treatment area under any other Division of the Land Management (Native Vegetation) Code 2018 (that is, there is not already a notification or certificate in place over the land).
  • The area intended to be cleared does not contain vegetation that forms part of a critically endangered ecological community.
  • I understand that the land cannot be cleared if clearing is likely to harm an animal that is a threatened species.
  • I understand clearing is not permitted if a critically endangered species (plant or animal) is present.
  • The intended clearing area does not contain any areas where native species comprise more than 50% of the vegetation cover.
  • Percentages of compromised groundcover have been calculated according to the rules required by the Code.
  • I have obtained written consent from all the owners of the landholding on which I am intending to clear.
  • To the best of my knowledge, there are no remediation orders or current compliance investigations on this landholding.
  • The intended clearing will be carried out in accordance with the Local Land Services Act 2013, the Local Land Services Regulation 2014, and the Land Management (Native Vegetation) Code 2018.
