Step 9: Do the works impact non-Aboriginal heritage?
This step helps you find out if your works may affect state or local heritage items, or archaeological relics, protected under the Heritage Act 1977.
Will the works impact non-Aboriginal heritage items or places?
If you answered yes
If your proposal will affect a place or item listed on the State Heritage Register (SHR) or subject to an Interim Heritage Order (IHO), you must get approval from Environment and Heritage NSW before starting work.
Approvals may be needed for:
- demolishing or altering heritage-listed buildings or structures
- excavating land that may contain archaeological relics
- damaging, moving or displaying heritage objects
- removing trees or vegetation from heritage land.
Some minor works may be exempt if they do not affect the item’s heritage significance.
You should:
- check if your item or site is listed on the State Heritage Inventory
- review standard exemptions or any site-specific exemptions.

You can:
- search the State Heritage Inventory to check for heritage listings.
- review your Local Environmental Plan (LEP) to find locally listed heritage items.
- contact Environment and Heritage or your local council’s heritage officer for advice.
If your project might disturb any archaeological relics, stop work until you confirm the legal requirements with Heritage NSW.
