Business Innovation and Investment (Provisional) visa (subclass 188E) – Entrepreneur stream

This provisional visa lets you carry out entrepreneurial activities in New South Wales.

Visa eligibility

You must be under 55 years of age.

Have a complying entrepreneur activity

You must be undertaking, or proposing to undertake, a complying entrepreneur activity in NSW, and have a genuine intention to continue this activity. Your complying entrepreneur activity must relate to an innovative idea that will lead to:

  • the commercialisation of a product or service in Australia, or 

  • the development of an enterprise or business in Australia. 

Your complying entrepreneur activity must not relate to any of the following categories: 

  • residential real estate 

  • labour hire 

  • purchase of an existing enterprise or a franchise in Australia.

Receive funding from an approved entity 

You must have one or more legally enforceable agreements to receive funding with a total of at least A$200,000 from one of the following entities:  

  • Commonwealth Government agency 

  • State or Territory government agency 

  • publicly funded research or innovation organisation 

  • higher education provider specified as a Table A or Table B provider under Part 2-1 of the Higher Education Support Act 2003 

  • investor registered as an Australian Venture Capital Limited Partnership or Early Stage Venture Capital Limited Partnership. 

At least 10% of the funding must be payable to the entrepreneurial entity within 12 months of the activity starting in NSW. This must be in the agreement. 

The entity that will conduct the activity must be either an individual, a company or a partnership. 

You must have held at least 30% interest in your entrepreneurial entity when you entered into the agreement. 

You must also have a business plan for the entrepreneurial entity. This business plan should note how your innovative idea will lead to: 

  • the commercialisation of a product or service in NSW, or 

  • the development of an enterprise or business in NSW 

All the funding provided or to be provided to the entrepreneurial entity under the agreement or agreements is unencumbered and lawfully acquired. 

Sufficient funds to settle in NSW 

You must provide evidence of sufficient funds for settling and living expenses for a minimum twelve months in NSW.

You need to apply for NSW nomination before you can apply to Home Affairs for this visa. Applying for NSW nomination from involves the following steps:

Submit an Expression of Interest (EOI) 

Submit an EOI through SkillSelect selecting NSW as your preferred state.;

Apply for NSW nomination 

Apply to NSW for nomination using our online form.

Pay application fee

You (or your migration agent) will be emailed a payment link immediately after submitting your online application form. This payment link is valid for 30 minutes only.

Your application will only be assessed after you completed the application payment. To ensure the timely assessment of your application, you must complete payment within the 30 minute timeframe.


  • applying from within Australia: A$902

  • applying from outside Australia: A$820

Application fees are non-refundable. Applications that remain unpaid will be closed by our office. Retain a copy of your receipt as proof of payment.

Application processing time

You will receive an outcome, or request for further information, within four weeks of your application payment.

Next steps

If you are nominated by NSW, you will receive an automatic invitation to apply for the visa through SkillSelect. This invitation is valid for 60 days.
