Apply for Skilled Work Regional visa (subclass 491) nomination

Nomination process

There are several important steps to NSW nomination:

  1. You must ensure you meet ALL visa requirements set by Home Affairs and ALL NSW nomination requirements for your respective stream
  2. Submit an expression of interest (EOI) in SkillSelect. Your EOI must be for the Skilled Work Regional visa (subclass 491) and NSW only
  3. Complete the application form below, providing ALL supporting evidence in a single .zip file
  4. Complete the application payment. You will be advised how to complete the application payment by the RDA office in your nominated region shortly after you submit the form 
  5. Wait for your application assessment. If your application is approved by your nominating region, it will be referred to Investment NSW for further compliance review
  6. If approved by Investment NSW, you will receive an invitation to apply for the Skilled Work Regional visa (subclass 491) by Home Affairs to the email address you provided in your SkillSelect EOI  

Important information about applying for NSW nomination

Before you complete the above form, you must read and understand the following:

  • You are not eligible for NSW nomination if you have previously been nominated by NSW for any skilled visa
  • You can only have one active application for NSW nomination. If you apply to more than one RDA office simultaneously, all applications will be declined
  • Your application is assessed by the RDA office in your nominated region. Do not contact Investment NSW for an update on your application
  • Your supporting evidence must be valid for a minimum of one calendar month from when you apply for nomination
  • You must ensure all information you provide in your application is correct. Providing incorrect or misleading information will result in your assessment being delayed and possibly declined
  • Your application form (along with all supporting evidence) is automatically forwarded to the RDA office in your nominated region. You will receive a copy of your application to the email address you entered in the form

Pathway

Regional NSW-based direct pathway

To apply under this pathway, you must:

  1. Ensure you are eligible for this visa subclass on the Home Affairs website
  2. Be currently living and working in their nominated (or closely related) occupation in a designated regional area of NSW, and have continuously done so for the past twelve (12) months with the same employer for a minimum of 20 hours per week
  3. Have a valid skills assessment in an occupation within a unit group that appears on the NSW Regional Skills List and is eligible for the visa
  4. Be paid at least the TSMIT level or $53,900 per annum (full time equivalent) excluding superannuation
  5. Provide evidence for all points claims in your SkillSelect EOI, and where you currently reside, with your application. You must also provide a copy of your SkillSelect EOI

This is the sum of your income from your qualifying skilled employment in your nominated occupation in regional NSW. You cannot include supplementary income. 
This is your average hours worked per week from skilled employment in your nominated occupation in regional NSW.  

Pathway 1 – Apply directly to an RDA office

To apply under this pathway, you must:

  1. Ensure you are eligible for this visa subclass on the Home Affairs website
  2. Confirm you meet the NSW basic eligibility criteria 
  3. Complete an EOI in SkillSelect and ensure that:
    • all information is accurate
    • your EOI seeks nomination for the Skilled Nominated visa (subclass 491) and NSW only
  4. Provide evidence for all points claims in your SkillSelect EOI, and where you currently reside, with your application. You must also provide a copy of your SkillSelect EOI

Regional NSW study exemption

You are exempt from the minimum work experience requirement under Pathway 1 if you have completed study in regional NSW within the most recent 24 months before applying to an RDA office; AND your study is related to your nominated (or closely related) occupation; AND your study in regional NSW makes you eligible to claim points for Study in regional Australia.

Points claim self-assessment

Information about what points you are eligbile to claim is available on the Home Affairs' website. NSW and RDA offices cannot pre-assess your eligibility to claim points or employment. 

Other points claims

Documents

Files must be grouped together and submitted as a single ZIP file with a maximium total file size of 20MB.

You should name each document so that it identifies the requirement that the document relates to. For example, passport bio-data page should be labelled: “Passport” etc.

You are required to submit supporting evidence for all points claims in your SkillSelect EOI. At a minimum, this includes: 

  • passport bio-data page
  • English assessment
  • skills assessment
  • evidence of your employment including:
    • bank statements showing evidence of income
    • payslips
    • employment contract
    • reference letter from you employer detailing the duration of employement, duties performed and hours worked per week
  • evidence of your current residency including:
    • 3 months of bank statements showing everyday transactions
    • lease/rental agreements
    • utility bills
    • driver's license/proof of age card 
  • evidence of your education/qualification
  • PDF copy of your SkillSelect EOI and points breakdown
  • evidence of all points claims
  • Form 956 (if using a migration agent)
  • evidence of regional NSW study (if applicable)

**All documents must be valid for a minimum period of one calendar month from the date you apply for nomination**

The personal information you provide on this form is subject to the Privacy & Personal Information Protection Act 1998. It is being collected by NSW Government and will be used for purposes related to NSW nomination under the NSW Business and Skilled Migration Program.  

The NSW Government may share the information provided in this form with the Australian Department of Home Affairs and the Regional Development Australia (RDA) office in your nominating region for the purposes of verification and processing your nomination application. The NSW Government will not disclose your personal information to anybody else unless authorised by law. I acknowledge that: 

  • NSW nomination is valid for one nomination and against one Expression of Interest (EOI) number only
  • The nominating RDA and/or NSW Government may contact other parties, such as employers, to verify the information that I have provided in my application
  • NSW Government may withdraw my nomination if I have provided false information in my application
  • NSW Government may withdraw my nomination if, after being nominated, I settle in another state or territory in Australia.

If granted a Skilled Work Regional (Provisional) visa (subclass 491) by the Department of Home Affairs, I agree to: 

  • Live and work in designated regional area postcodes in NSW while holding this visa
  • Advise the nominating RDA of any change of home or business address while holding this visa
  • Advise the nominating RDA of any changes to my contact details while holding this visa
  • Respond to surveys or requests for updated information on employment and settlement in NSW.
