Declarations and Privacy Statement

This notice applies to everyone submitting a Registration of Interest (ROI) or an Application for NSW nomination for the National Innovation visa (NIV). By ticking the declaration box and submitting your form, you confirm that you have read, understood and agree to all terms below.

Terms used in this statement which are defined in the Privacy and Personal Information Protection Act 1998 (NSW) have the same meaning in this document, unless otherwise indicated or the context otherwise requires.

1. Privacy Statement

1.1 Authority & Contact

The NSW Premier’s Department, through Investment NSW, a division of the NSW Premier’s Department (Investment NSW), is collecting your personal information under the Privacy and Personal Information Protection Act 1998 (NSW) (PPIP Act).

For the avoidance of doubt, references to Investment NSW in this document should be taken to mean the NSW Premier’s Department as the relevant public sector agency for the purposes of the PPIP Act.

1.2 Collection of Information

The information you provide is required to assess your eligibility for NSW nomination for the National Innovation visa (NIV).

1.3 Purpose and Use

We use your information only for:

  • assessing your ROI and/or application, and
  • administering any subsequent nomination and post-nomination obligations.

Although supply of the information is voluntary, if you do not supply the requested information, we cannot process your submission.

1.4 Disclosure

We may disclose your information to:

  • NSW Government agencies
  • Australian Government agencies (including the Department of Home Affairs)
  • external experts (e.g. industry, technical or financial specialists, bodies or associations)
  • universities or other educational institutions
  • professional associations
  • your current and former employers

for verification and assessment purposes. Information may also be released where required by law, including under the Government Information (Public Access) Act 2009 (NSW) (GIPA Act).

1.5 Access, Correction, Retention & Disposal

You have the right to request access to, and correction of, your personal information. Records are retained in accordance with the State Records Act 1998 (NSW) and disposed of when no longer required.

2. Declarations – Registration of Interest (ROI)

By submitting an ROI you declare and consent that:

  1. Accuracy of Information – All information in my ROI is true, complete and accurate.
  2. Basis of Assessment – I understand Investment NSW will assess my ROI solely on the information provided and may refuse any later application if this information is false or misleading.
  3. Consent to Verify – I authorise Investment NSW to disclose and verify my information with the bodies listed in §1.4.
  4. No Guarantee of Invitation – I understand an ROI is not an application and does not guarantee an invitation to apply for nomination.

3. Declarations – Application for Nomination

By submitting an application you declare and consent that:

  1. Truth & Accuracy – All information in this application and my preceding ROI is true, complete and accurate.
  2. Consent to Verify – I authorise Investment NSW to disclose and verify my information with the bodies listed in §1.4.
  3. Understanding of State Nomination – I understand NSW nomination does not guarantee visa grant; that decision rests solely with the Department of Home Affairs.
  4. Independent Professional Advice – I have sought my own legal, financial and professional advice and release Investment NSW from liability for any commercial or financial loss.
  5. Probity – Neither I nor my spouse/de facto partner has a history of serious criminal, civil or regulatory offences, insolvency, or business/investment practices unacceptable in Australia.
  6. Post-Nomination Obligations – If nominated and granted an NIV, I will:
    1. Notify Investment NSW of any change to my contact details within 28 days; and
    2. Respond promptly to surveys or requests for information about my innovation activities in NSW in the 12 months proceeding the grant of an NIV.
  7. Withdrawal of Nomination – Investment NSW may withdraw my nomination if I provide false or misleading information, cease to meet the criteria, or breach the declarations above. Before withdrawal, Investment NSW will notify me and give me a reasonable opportunity to respond.

By checking the declaration box, you acknowledge and agree to everything set out in Sections 1–3 above.
