Running a market stall selling second-hand goods in NSW

You will need a licence if you sell prescribed second-hand goods
You will need a second-hand dealer's licence if you are selling or trading in prescribed second-hand goods for more than 6 days in a 12 month period. You can visit Australian Business Licence and Information Service (ABLIS) to find out more about the licence you need.
Prescribed second-hand goods that require a licence
Prescribed second-hand goods are:
- items of jewellery that include gemstones or precious metals, including watches
- gemstones and precious metals
- electric or electronic goods, including mobile phones, global positioning system equipment and audio devices
- computer hardware, including tablet computers and video game consoles
- photographic and video equipment, including digital cameras, digital imaging equipment and video recording devices
- musical instruments
- sporting and recreational goods
- watercraft used, or capable of being used as a means of transportation on water, including parts of a watercraft
- portable engine-powered, motorised and air-powered tools and equipment
- car accessories.
Your obligations when selling products
When selling products, you have a legal obligation to provide goods that:
- are safe for use and free from defects that can cause injury
- comply with safety requirements for certain items such as baby dummies, bicycles and children’s toys and information must be given to consumers before buying these products.
For products such as clothing, you might also have to provide more information such as care instructions.
Register your business name
If you want to trade under a business name that is not your own name, you must register your business name.

- register your business name
- renew your business name, or
- search for a business name.
