Creating new travel choices
E-scooters could be a sustainable and accessible transport option for the people of NSW, better connecting people to public transport and linking communities to jobs, services and town centres.
However, it is currently illegal to use privately owned e-scooters on NSW paths and roads. We are exploring options to address this so that people may legally ride e-scooters.
Draft rules for e-scooter use
We have developed draft key rules (PDF 102.44KB) that would support the safe use of e-scooters. Our goal is to prioritise safety for riders, pedestrians, other road users and the broader community.
The draft key rules have been informed by:
- rules being tested as part of the NSW shared e-scooter trials
- trial data and independent evaluation
- data and lessons learned from other states and jurisdictions where it is legal for people to ride e-scooters
- road safety research and evidence.

Engaging stakeholders and experts
We are engaging experts, advocacy groups and others to seek feedback on the draft key rules.
This feedback will be considered before decisions are made about the final rules for e-scooter use in NSW.
We have received feedback from:
- submissions to the NSW Parliamentary Inquiry into the use of e-scooters, e-bikes and related mobility options
- hearings at the Parliamentary Inquiry, which took place in October 2024
- Transport’s Accessible Transport Advisory Committee, which consists of 25 disability and ageing advocacy organisations
- Transport’s Road Safety Advisory Council, a key forum made up of 16 road user and safety organisations
- the local government sector, including councils from metropolitan and regional areas, Local Government NSW and Office of Local Government
- business advocacy organisations
- active transport peak advocacy organisations
- businesses providing shared e-scooters and shared e-bikes
- state government agencies, including the E-micromobility Interagency Group.
