What’s included
The register lists the new agreements we have with landholders and includes:
- identification number
- type of agreement
- commencement date
- local government area
- Interim Biogeographic Regionalisation for Australia (IBRA) subregion.
- area of the agreement (in hectares)
- term of the agreement.
For biodiversity stewardship agreements, the register may also include:
- the biodiversity assessment report (with the landholder’s consent)
- the number and class of biodiversity credits created.

With landholder consent, we may also publish additional information such as:
- names of current and previous landowners
- lot and Deposited Plan (DP) numbers
- copies of the agreement and management plan.
All personal or sensitive information is handled in line with NSW privacy law.
Biobanking agreements
190 biobanking agreements were originally made between the Office of Environment and Heritage and landholders. We now manage these agreements as biodiversity stewardship agreements.
Each agreement has a unique identifier, for example BA00123_01.
Agreements may be varied with the landholder as needed.
Set Aside Conservation Agreements
Our role for Set Aside Conservation Agreements is limited to:
- signing the agreement
- registering the agreement on the land title
- publishing the agreement on the public register.
These agreements are developed by the Department of Climate Change, Energy, the Environment and Water (DCCEEW) under the NSW Government’s Policy for resolving investigations under the now repealed Native Vegetation Act 2003.
DCCEEW manages these agreements, including:
- ongoing landholder support and compliance
- ecological monitoring
- requests to vary or end agreements
- reporting on outcomes.

Future updates
Although the Act only requires the register to include agreements made under Part 5, we may add information about other private land conservation agreements including older agreements managed by our predecessor organisations.
Before publishing any details, we will contact each landholder for consent.
There are around 1650 such agreements.
