Change aspects of your licence
We understand that your aspirations, business model, or conditions may change. As a result, you may need to change one or more aspects of your liquor license.
Name
Changing the name of your venue can be completed through a simple application.
There are some restrictions on the new name and it must reflect the nature of your business. Limitations include:
- a prohibited name
- an objectionable or inappropriate name
- certain words associated with the operation of gaming machines

Boundaries
A change of boundaries modifies the licensed areas of your premises.
Any authorisations on your licence will not automatically change with the boundary extension. To include your existing authorisation within any boundary extension, you must lodge the appropriate application for that authorisation.
To illustrate the change in boundaries you’ll need to produce a plan that outlines the current licensed footprint in red and the proposed licensed area in a separate colour. Be sure to include a key to show what the colours represent. Black and white plans will not be accepted.

Minors area
If you have a hotel licence and your proposed footprint extension will impact your Minors Area Authorisation (MAA) – you must also lodge an application to change your MAA.

Multiple premises for producer/wholesalers
To licence multiple producer/wholesaler venues, the venues need to either be:
- in the same wine region
- within 20km of each other if in non-metropolitan areas, or
- within 10km of each other if in a metropolitan area.
Checklist of what you need to lodge
When lodging your application, use the below as a guide to ensure the decision process isn’t delayed.
- ensure all attachments are in PDF format
- complete all sections of the application form and fee – including the site notice if required
- a plan of the current licensed area and any authorisations
- Outline the current licensed area in red, proposed boundary change in another colour, and authorisations in another colour. Include a key to show the meaning of each colour
- a Statement of Risks and Potential Effects (SorPE) is required if:
- the application is to increase licence boundaries by more than 50%, and
- where a SoRPE (or CISB, under past legislation) was provided with the original licence application (or would currently be required for an application of this type).

How to submit a floor plan with a liquor licensing application (PDF 2MB)
Timeframes
Change of boundaries applications take about eight weeks in total once all the required information has been submitted. This includes the Noticeboard period of 30 days.
- Once you lodge a complete application, it will be posted on the Liquor and Gaming Application Noticeboard for a 30-day period where the community, local consent authority and police can make a submission on your application.
- Once the 30-day submission period ends, your application will be determined within four weeks.
Applications that do not have all the required information will be delayed. We will contact you to request the missing details, however we do rely on your speedy response with the missing information to progress your application.

Conditions
Your liquor licence may have conditions imposed. You can apply to change your licence conditions should your circumstances or business needs change.
Conditions on your liquor licence are imposed by either the Independent Liquor & Gaming Authority (ILGA) or the Secretary.
The source of each condition is noted next to the relevant condition on your liquor licence.

Change trading hours
To change your trading hours within standard trading, lodge a change of conditions application (PDF 373.69KB).
The hours of any authorisations will not automatically be changed if you change your licence trading hours. If you want to change the hours relating to any existing authorisation, you will need to lodge an application for that authorisation. For example, to change the hours of a primary service authorisation, use the primary service authorisation form (PDF 520.43KB), or to change the hours for a drink on premises authorisation, use the drink on premises authorisation form (PDF 312.42KB).
To change your trading hours to longer than standard trading, lodge an application for an extended trading authorisation. Here are the forms for applying for an extended trading authorisation:

Multi-occasion extended trading authorisation (MOETA)
With a MOETA, premises outside the metropolitan area can trade until 3am on up to 12 occasions over a 12-month period.
A MOETA is a great option for regional venues that:
- have standard trading hours
- would like to occasionally trade past 12:00am.
A Statement of Risks and Potential Effects (SoRPE) must be submitted with this application.
Cost
There is no application fee for this authorisation, however it attracts an annual loading. Refer to the Liquor Fee Schedule for the trading hours loading.

Notification of function dates
Once you have been granted a multi-occasion extended trading authorisation, you must use the online multi-occasion extended trading form to notify us of the dates you'll be using extended trading.
You must notify us at least six weeks before each occasion. You can notify us earlier than six weeks and you can notify us of more than one date on the notification form.
Development consent
To change the current conditions or trading hours on your licence, you must check if you also need to vary the development consent for your premises. It is up to you to lodge the relevant application with your local council.
Tenancy
In some circumstances you can lease or sub-lease your premises, or parts of your premises.
What you cannot lease or sub-lease:
- the right to sell liquor for consumption on the premises
- the parts of your licensed premises where you normally sell liquor (unless located in a shopping centre) or operate gaming machines.

- include a plan showing the area to be let, in relation to the licensed boundary.

Business type
We understand that your business may change over time. You can apply to make these changes to your licence at any time.
You may need to complete a Statement of Risks and Potential Effects (SoRPE) before applying.
For on-premises licence
You can apply to change the kind of business or activity carried out on the licensed premises. Examples include accommodation, catering, restaurant.

For other licence types
If you have a licence - in other words, an on-premises licence -and you want to apply for a different licence type, such as a Hotel licence, you must surrender your old licence while applying for your new. These should be done at the same time.
1. To surrender your licence lodge a surrender your liquor licence application.
As part of the application, you will need to enter:
- Last date of trading for the venue.
- Enter a comment on the application form that you are proposing to surrender the licence and note that you are applying for a new licence.
2. Apply for a new liquor licence.
Manager approval and appointment
A corporation can hold a liquor licence just as an individual can. The difference being that the corporate licensee must appoint an approved manager to the licensed premises.
There is a two-step process of approval and appointment.
Step 1 - Approval of manager
We need to determine that the proposed approved manager is a fit and proper person for the role.
Online application:
To complete the online form you will need:
- A NSW National Police Certificate that is less than three months old. Visit NSW Police to find out how to obtain a copy of your certificate
- Evidence of Responsible Service of Alcohol (RSA) qualifications
- Evidence of Responsible Conduct of Gaming (RCG) qualifications - if applying to manage a hotel or a club. Find out more about RSA and RCG training
- If applicable, a signed applicant Declaration: Approved manager approval (PDF 619.6KB).
Apply now: Complete online approval of manager form. If the application is approved, the Approved Manager will receive a personal licence number, starting with LIQXA.
Step 2 - Appointment of manager
An Approved Manager cannot be appointed without having first completed the step above and receiving an LIQXA number.

Notify interest in liquor licence business
Notify us if you:
- have an interest in a liquor licence
- no longer have an interest in a liquor licence.
Online application
- To notify interest as a premises owner you will need to provide proof of ownership. This can be in the form of a title search and contract of sale or a rates notice
- To notify interest as a business owner you will need to provide proof of purchase of the business such as a contract of sale which includes the date of settlement
- If a Trust has purchased the business, you will need to provide a copy of the Trust Deed and a copy of the contract of sale including the settlement date or a copy of an extract from the ABR register.

No fees are required for this application.
6-hour closure period
The 6-hour closure period is a continuous block of 6 hours when you cannot sell or supply liquor on your licensed premises. The same 6-hour block applies to each day.
The 6-hour closure – usually from 4am to 10am – applies to any licence granted since 30 October 2008.
You need to change the 6-hour closure period on your licence if it conflicts with new trading hours you want to establish.
You can lodge applications to change your trading hours and applications to change your 6-hour closure period together. We'll assess them at the same time.
Development consent
To change the current conditions or trading hours on your licence, you must check if you also need to vary the development consent for your premises. It is up to you to lodge the relevant application with your local council.

Move a liquor licence (changing venues, location)
Liquor licences are attached to a premises, not a person.
If you are moving your business to another location, you must apply to take your liquor licence with you. In the Liquor Act 2007 this is referred to as removing a licence.
We treat an application to move a liquor licence from one venue to another the same as an application for a new liquor licence. The fee to move a liquor licence is the same as the fee to apply for a new liquor licence of the same type.

Options for moving (removing) your licence
You can move your licence either by
- Applying for a new licence and surrendering the existing licence, or
- Applying to remove the existing licence
Note: If your licence has gaming (club or hotel licences) you must lodge a removal application.
Apply for a new licence and surrender the existing licence
These are online applications and are therefore easier to complete and can be faster to finalise. You need to lodge your new licence application at the same time as you lodge your application to surrender your licence. This ensures they are processed at the same time so the new licence will not take effect until your existing licence ceases. You will be issued with a new liquor licence number.

Remove the existing licence
This is a paper-based form which takes longer to process as it is not automated. You will keep your existing licence number.

Conditions and authorisations
We may include new conditions on your new licence, depending on how you want to operate your venue, and any feedback we get about your proposed move.
You will always have a chance to respond before we impose new trading hours or conditions on your liquor licence.
Any authorisation that applies to your liquor licence at its current premises will no longer be valid, including: primary service, minor's area, extended trading.
If you want new authorisations for your new premises, you must apply for them at the same time you lodge your application to move your liquor licence.
Unrestricted club
If you are a club with unrestricted trading hours, you may continue to operate without restrictions to the club’s consumption on-premises trading hours if your new licensed premises is:
- zoned or designated for the same purpose as the existing premises land and is within a 1km radius of the existing premises,
or
- urban use land* (or adjoins urban use land) and is within a 5km radius of the existing licensed premises.
* urban use land means land zoned or otherwise designated for use for urban purposes under an environmental planning instrument.
Gaming Machines
When you apply to move a club or hotel liquor licence you must also apply to move any gaming machine entitlements linked to your premises.
If moving your gaming machine entitlements with your licence, you must consider the impact of those entitlements at your new premises.
If selling your gaming machine entitlements, you must ensure this is completed prior to the removal of the liquor licence form your existing premises.

- A current NSW National Police Certificate – for individual applicant (less than 3 months old)*
- An ASIC extract providing details of directors and officeholders - for corporate applicants*

You are able lodge your application without including the above documentation, but your proposal won't progress to a decision until it is provided to us.
