Exemptions and public registers
Exclusions, exemptions and codes of practice
Under privacy legislation, there are several exceptions and exemptions. Where exceptions or exemptions apply, an agency may not be required to comply with some or all of the privacy principles. This might apply in a certain situation or in relation to certain information collected.
At DCS, when we seek to rely on an exemption, we will assess how that applies in the specific circumstances and explain it in a privacy collection notice.
Like exemptions, a privacy code of practice is a legal instrument which allows an agency to depart from information privacy principles and this may limit the liability of an agency in relation to the principles. An example of this which applies to the services of ID Support, a business area within DCS, is the ID Support Privacy Code of Practice - Identity remediation services.

Public register information
A public register is a register of information that is publicly available or open to public inspection. DCS has several public registers.
We only disclose personal information kept in the above registers in accordance with what is required or permitted under the relevant laws.
If you have any concern about your personal information being on a public register, you can contact the relevant business area within DCS or email: privacy@customerservice.nsw.gov.au.
Any request for your information to be suppressed from a public register must be in writing and must provide reasons for the request. In making any decision to suppress your information we will balance your rights with the public interest in maintaining public access to the information, in accordance with legal requirements.
