The NSW Department of Climate Change, Energy, the Environment and Water is proposing a new method to calculate the value of water taken illegally.
The proposed new method is designed to ensure the Natural Resources Access Regulator (NRAR) can issue charges that better reflect the real value of water illegally taken. It uses public data to come up with values that are more consistent and better reflect the market value of water.
The current method for valuing illegally taken water is prescribed in the Water Management (General) Regulation 2018, clause 20, and is based on trade prices. Under this method, issuing a charge does not deter people from illegally taking water.
