Applying for letters of administration
You may need to apply for letters of administration rather than a grant of probate if there is no will, or an executor is not named or is unable to act.
When to apply
Apply for a grant of probate or letters of administration within 6 months of the death, unless there is a reasonable explanation for the delay.
You will need to apply for letters of administration if:
- there is no will
- the will is not valid
- there are no executors named in the will
- the executor doesn’t want to, or is unable to, act
