Transport for NSW advises vessel operators that the limit for ‘enclosed waters’ and ‘open waters’ around the confluence of the Clyde River and Batemans Bay has been clarified for the purpose of Part 6 (Safety equipment and facilities) of the Marine Safety Regulation 2016.

Transport for NSW has determined the open and enclosed waters limit for the Clyde River and Batemans Bay to be defined by an imaginary line extending from the eastern limit of the Clyde River Training Wall in a north-easterly direction to the land-based location of the Square Head Sector Light.
This means all waters of the Clyde River upstream (in a westerly direction) of this line are considered to be ‘enclosed waters’, and all waters downstream into Batemans Bay (in an easterly direction) are considered to be ‘open waters’ the purpose of Part 6 (Safety equipment and facilities) of the Marine Safety Regulation 2016. This position represents long-standing local arrangements, and correlates with lifejacket wear requirements for crossings of the Clyde River Bar.
NSW Marine legislation prescribes recreational vessel operators on NSW waters must comply with certain safety equipment provisions, and the degree of equipment required is dependent on the vessel type and whether the vessel is being operated on ‘enclosed waters’ or ‘open waters’.
Vessel operators are reminded to check their area of intended voyage, and what safety equipment and lifejacket wear requirements relate to the voyage.
